Understanding Your Rights Under the ADA

The Americans with Disabilities Act (ADA)* of 1990 outlines a number of rights related to career services.  The ADA:

  • Helps those with disabilities access employment opportunities and benefits
  • Applies to employers with 15 or more employees
  • Requires employers to provide reasonable accommodations to qualified applicants and employees
  • Defines disability
  • Establishes guidelines for the reasonable accommodation process
  • Addresses medical examinations and inquiries
  • Is regulated and enforced by the US Equal Employment Opportunity Commission (EEOC)

The ADA does not:

  • Guarantee employment
  • Waive qualifications such as essential job skills, experience, or education
