Understanding Your Rights Under the ADA
The Americans with Disabilities Act (ADA)* of 1990 outlines a number of rights related to career services. The ADA:
- Helps those with disabilities access employment opportunities and benefits
- Applies to employers with 15 or more employees
- Requires employers to provide reasonable accommodations to qualified applicants and employees
- Defines disability
- Establishes guidelines for the reasonable accommodation process
- Addresses medical examinations and inquiries
- Is regulated and enforced by the US Equal Employment Opportunity Commission (EEOC)
The ADA does not:
- Guarantee employment
- Waive qualifications such as essential job skills, experience, or education
